RESIDENTIAL LEASE AGREEMENT
This Residential Lease Agreement is entered into by and between Paul Thuman, hereinafter referred to as the “Lessor”, and the guest making the reservation, hereinafter referred to as the “Lessee”.
The property subject to this agreement is located at 401N Tres Regalos, Pastor Díaz, Jacó, Puntarenas, Costa Rica.
1. Grant of Lease
The Lessor hereby leases to the Lessee, and the Lessee hereby rents from the Lessor, the residential vacation property described above, to be used exclusively for temporary residential purposes.
2. Term of Lease
This lease shall commence on the confirmed check-in date and shall terminate on the confirmed check-out date indicated in the reservation. Any extension of stay is subject to availability and additional agreed-upon charges.
3. Rental Payments and Security Deposit
The Lessee agrees to pay the total rental amount corresponding to the number of nights reserved. Full payment is due in advance at the time of booking.
In addition, a refundable security deposit of USD $500.00 is required to cover potential damages to the property. The deposit will be returned after departure and inspection, less any applicable deductions.
4. What to Bring
Guests should bring personal toiletries, including insect repellent. A limited supply of basic consumables (toilet paper, paper towels, and similar items) is provided upon arrival. Guests should plan to replenish these items as needed.
5. Lessee’s Obligations
The Lessee agrees to read, understand, and comply with all house rules and the following conditions:
- No pets of any kind are permitted. Violation will result in immediate eviction without refund.
- The primary Lessee must be at least 25 years of age.
- Maximum occupancy: 6 adults and 1 child under the age of 7.
- No smoking is allowed inside the property.
- Guests must respect neighboring properties and maintain reasonable noise levels.
- Exceeding occupancy limits or engaging in illegal activities will result in immediate termination.
- The property must be left in substantially the same condition as received. Additional cleaning will be charged at $25 per hour.
- The Lessee is responsible for any damage caused by themselves, guests, or invitees.
- Lost or damaged keys will be charged accordingly.
- No alterations or modifications may be made without written consent.
- Personal belongings are the sole responsibility of the Lessee.
6. Hold Harmless / Limitation of Liability
The Lessor shall not be liable for any loss, damage, injury, or inconvenience suffered by the Lessee or guests, including but not limited to personal injury, loss of personal property, service interruptions, appliance failures, weather conditions, natural disasters, or events beyond the Lessor’s control.
7. Rights of the Lessor
The Lessor reserves the right to enter the property, with reasonable notice, for inspection, maintenance, or necessary repairs. The Lessor is responsible for major repairs required to maintain habitability.
8. Insurance and Destruction of Premises
The Lessor shall maintain hazard and fire insurance on the property. In the event the premises become uninhabitable due to causes beyond the Lessor’s control, this agreement shall terminate without further liability.
9. Termination
Failure to comply with any terms of this agreement may result in termination upon twenty-four (24) hours written notice, without refund.
10. Assignment
The Lessee may not assign, transfer, or sublease this agreement without the prior written consent of the Lessor.
11. Entire Agreement
This document constitutes the entire agreement between the parties.
Policies and Restrictions
- Reservations: Reservations are confirmed upon receipt of the required payment.
- Cancellation Policy: 100% refund up to 60 days before arrival; 50% refund between 30–60 days; no refund within 30 days of arrival.
- Damages: Any damage will be deducted from the security deposit. Excess damage costs are the responsibility of the Lessee.
- Security Deposit: Returned after inspection, minus applicable charges.
- Weather Credits: Issued only if an official evacuation order is in place.
- Mechanical Issues: No refunds will be issued for appliance or mechanical failures.
- Check-in / Check-out: Check-in at 3:00 PM, Check-out at 11:00 AM. Late check-outs incur additional charges.
